Encroachment & Driveway Permits
An encroachment permit is required whenever the placement of items or structures occurs in the public right of way. The type of permit required depends two considerations:
- Who maintains the right of way
- Whether the encroachment is temporary or permanent
Town of Garner Maintained Right of Ways
Encroachments on Town maintained rights of way must be reviewed and approved by the Town of Garner Engineering Department. A minor encroachment permit is required for temporary items, such as awnings, overhead or sidewalk signage, street furniture or temporary structures. A major encroachment permit is required for permanent structures such as landscaping, utilities, irrigation, telecommunication devices, or building elements. All Town encroachment permits must include an Encroachment Agreement as part of the application.
A driveway permit is required for any properties requesting driveway improvements or installing a new driveway access on Town maintained roads. Please review the Driveway detail for Town Standards.

NCDOT Maintained Right of Ways
Encroachments on NCDOT maintained streets must be permitted by the NCDOT. Permit applications must be submitted to the NCDOT Wake County District 1 Office and do not require encroachment agreements from the Town of Garner. However, any NCDOT encroachments as part of a subdivision/site plan must be reviewed by the Town in conjunction with the encroachment permit to the NCDOT prior to approval.
