AMENDING THE TOWN OF GARNER’S EXTRATERRITORIAL JURISDICTION (ETJ)

The Garner Town Council will receive public comment on amending the Town of Garner ETJ ordinance to include an approximate additional 6,285 acres, and to remove approximately 454 acres, as approved by the Wake County Board of Commissioners on January 17, 2017.   According to the most recent Wake County Tax Assessor’s Office data on the properties affected, in whole or in part, by this action are included on the following map.  (Map of affected properties)

In accordance with North Carolina General Statutes (NCGS) 160A-360, the Town of Garner hereby notifies that the Town intends to exercise territorial jurisdiction, effective March 16, 2017, for all properties mapped in yellow (“Approved Extension Areas”) on the above Map; and to cease the exercise of territorial jurisdiction, effective March 6, 2017, for all properties mapped in red (“Approved Removal Area”).

Upon conclusion of the public hearing, adoption of the ETJ ordinance shall be considered by the Town Council.  The effect of the adoption of the ordinance extending the ETJ shall be that all planning, zoning and building inspection services shall no longer be provided by Wake County, but shall be provided by the Town of Garner for “Approved Extension Areas” and vice versa for the “Approved Removal Area”. 

Pursuant to NCGS 160A-362, any resident of the ETJ area may apply to the Wake County Board of Commissioners to serve as a representative on the Garner Planning Commission or Garner Board of Adjustment by submitting a completed application to the Town Clerk’s Office.  Appointments are made annually.  An application may be obtained by calling 919-773-4406, or visiting online at http://garnernc.gov/government/town-boards-committees

Please remember: An ETJ extension is not annexation, nor is it a necessary step toward annexation.  Properties located in the ETJ will not be taxed by the Town of Garner.  Should you require any further information or clarification, please do not hesitate to reach me at 919-773-4445 or jtriezenberg@garnernc.gov.  A second public hearing notice to establish new zoning for your property(ies) will follow in the near future.
